Issues are whether the officer had probable cause to stop or contact you or whether the chemical test evidence is beatable.

San Diego county DUI checkpoint in Oceanside Saturday night

A San Diego DUI checkpoint is scheduled for 9 p.m. Saturday to 3 a.m. Sunday at an undisclosed location, according to Oceanside police.

The San Diego California DUI checkpoint aims to reduce drunken driving on local streets, but must be run in conformity with important California Supreme Court guidelines or else any drunk driving arrest is unconstitutional; a good lawyer will ensure protection.

San Diego DUI arrestees have right to breath or blood test and must complete the chosen test or face a possible refusal

San Diego DUI chemical tests are usually obtained at the county jail or at the police station.

What happens is that the San Diego drunk driving arrestee will be offered a chemical test of breath or blood, and/or sometimes urine.

The San Diego DUI arrestee has the absolute choice to a blood or breath test. If for example the person says she or he wants a breath test, it is the obligation of the officer to allow that person to complete the breath test. Recently in San Diego, a San Diego Charger was denied this right.

San Diego DUI Breath test results are usually available immediately. San Diego DUI blood samples are sent to a lab for later analysis to determine the BAC or possible presence of drugs. Many delays can occur, to the person's advantage at DMV.

If the San Diego DUI suspect refuses to submit to chemical testing, she or he will usually be booked for San Diego DUI - driving under the influence and for a refusal if she or he refuses to providea breath or blood test.

If the breath test machine indicates there was "mouth alcohol", or if the subject is unable to complete the chosen test, the subject would have to complete a remaining test.

The San Diego drunk driving refusal enhancement will carry enhanced punishment and increased penalties on the driving under the influence charge incluidng a much longer license suspension without the possibility of a restricted license and/or an increased jail sentence.

The act of refusing may be also admissible in San Diego Superior Court as evidence of "consciousness of guilt".

In California, refusal to submit to a chemical test can result in an automatic one year suspension of driving privileges, regardless of whether the suspect is convicted of a San Diego DUI.

If the San Diego DUI suspect refuses to take a chemical test the police may and will usually restrain the individual and forcefully withdraw blood. This is common in situations involving an accident with death or injury.

How do San Diego Superior courts deal with San Diego DUI FST’s that are not performed in accordance with NHTSA? These are the frequently asked questions about San Diego DUI SFST’S.

Extensive studies of field sobriety testing (FST’s) has been done by The National Highway Traffic and Safety Administration (NHTSA) in order to determine the possibility of intoxication. Many of these studies are open to scrutiny. California DUI lawyers have written about various issues and problems in this area.

If a DMV hearing is requested within ten (10) days, your DMV TEMPORARY will be extended & there will be a stay (delay) of any suspension until the outcome of your DMV hearing is determined.



4. Do not confuse this initial 30 day TEMPORARY DRIVER LICENSE with your court date!

The DMV and criminal proceedings are separate and independent. The outcome of one almost never affects the other. Sometimes the officer or the DMV paper confuses or misleads you to believe that the TEMPORARY DRIVER LICENSE is good "until the court date". If there are approximately thirty (30) days from your arrest date to your court date, this may just be a dangerous coincidence. There usually are months before your DMV hearing takes place.



3. There are three (3) issues at the hearing if you completed a chemical test. (See reverse side of DMV paper.)



Issues are whether the officer had probable cause to stop or contact you or whether the chemical test evidence is beatable.



2. The DMV has the burden of proof to prevail on all three (3) issues. If DMV meets the burden of proof on two (2) issues, you win!

Last NIght's North San Diego DUI Checkpoint Report & Statistics

San Diego county law enforcement is intent on doing regular drunk driving checkpoints in an effort to make San Diego DUI arrests.

On Saturday, June 6, Escondido's Police Department conducted a San Diego DUI & California Drunk Driving Checkpoint at the intersection of Valley Parkway and Juniper Street from 6:00 PM until 12:15 AM. The San Diego DUI checkpoint was to detect impaired drivers, make DUI arrests, and have a visible drunk driving roadblock operation to deter driving under the influence.

The Supreme Court requires strict adherence to a number of criteria. Here are the statistics from this weekend San Diego County drunk driving checkpoint:

Of the 2,150 vehicles entered the San Diego DUI checkpoint westbound on Valley Parkway, 113 vehicles sent to secondary (drivers who could not produce a drivers license or who were suspected of being DUI - under the influence of alcohol or drugs). Eleven drivers were given DUI FST's. Of those eleven, eight drivers were arrested for San Diego California DUI - driving under the influence of alcohol or drugs.

Five drivers attempted to avoid this checkpoint by making a U turn and driving the wrong way down Valley Parkway. Four of the five drivers were caught and all four drivers were found to be unlicensed. The law allows drivers to avoid a checkpoint as long as they violate no law in doing so. In this case, these five drivers drove the wrong way.

The question becomes was there a proper escape route otherwise available. If not, a San Diego DUI lawyer may ask the court to suppress the DUI evidence and dismiss the case in court and at DMV.

Everyone is talking about the pink DMV order of suspension. What is it? What does it mean? Here's the San Diego DMV / DUI Hearing stuff you need to know:

A San Diego DMV hearing for a possible license suspension is like a mini-DUI trial without a jury, but with much different San Diego DMV rules, San Diego DMV laws and San Diego DMV procedures. The San Diego DUI / DMV hearing is presided over by a Driver Safety Officer (DMV hearing officer) rather than a real judge, an employee of the DMV not trained in law who acts as both prosecutor and judge. As unfair as it is, she or he can legally object to your evidence, rule on her or his own objection, dually engage your San Diego DUI / DMV lawyer, and admit or not admit either party's evidence.



The San Diego Driver Safety Officer offers evidence in the form of documents and/or witnesses. The Driver Safety Officer offers the San Diego drunk driving / DUI police report, DMV records, San Diego DUI alcohol reports and the important San Diego DUI officer's sworn statement entitled a "DS 367." With no Fifth Amendment right at the hearing, your San Diego DUI / DMV attorney usually will not want you to be present at the hearing since the Driver Safety Officer can call you as a witness and force you to testify against yourself if you ill-advisedly appear.

Top San Diego DUI Police Cop retires / Source Code revealed

The #1 San Diego PD Drunk Driving Cop, Gilbert Ninness, retires in midst of “cabal,” a team that included 2 San Diego DUI police officers and 2 private divorce investigators. These guys were hired by a wife to follow this poor diabetic who needed medical treatment and then arrest him for a San Diego DUI.

San Diego DMV Officer Sharon Galbo asked SDPD DUI Cop Ninness about the role of private investigators in the San Diego DUI arrest: “Was this, like, an unusual evening for you? Does this sort of thing happen often? What were you thinking?” After the DMV hearings arising out of this San Diego DUI arrest, Ms. Galbo set aside the license suspension action.

Months after the San Diego DUI arrest, Steel filed a civil claim against the city of San Diego for false arrest, battery and denial of urgent medical care. 3 weeks later, the San Diego City Attorney's Office filed San Diego DUI charges against Steel, which he believes was in retaliation for his claim.


In other breaking DUI news, Minnesota settled with the manufacturer for drunk driving breath tests, allowing defendants access to the machines' computer programming language. They have given the defense attorneys everything they need to analyze the source code, Department of Public Safety Commissioner claimed in a news release the deal.

DUI cops need the Intoxilyzer 5000EN to keep drunk drivers off our roads. Of the 38,699 DUI or drunk driving incidents in Minnesota in 2007, the Intoxilyzer 5000EN was used in about 24,000 of these cases. The prosecutor should hand over the source codes if DUI criminal defense lawyers for the defendants who request them indicate the codes may reveal deficiencies in the machine that could affect guilt or innocence. But the state does not have the info.

Minnesota sued CMI, the Kentucky manufacturer of the Intoxilyzer 5000EN, to gain access to the codes. The company, which supplies state's 260 breath contraptions, initially claimed the information was proprietary. Not anymore.

Many states are dealing with the source code issue.
