The thing is, the license suspension hearing is very serious. It is much similar to a mini-DUI trial without a jury, but with much different San Diego DMV rules, San Diego DMV laws and San Diego DMV procedures. The San Diego DUI / DMV hearing is presided over by a Driver Safety Officer (DMV hearing officer) rather than a real judge, an employee of the DMV not trained in law who acts as both prosecutor and judge. As unfair as it is, she or he can legally object to your evidence, rule on her or his own objection, dually engage your San Diego DUI / DMV lawyer, and admit or not admit either party's evidence.



The San Diego Driver Safety Officer offers evidence in the form of documents and/or witnesses. The Driver Safety Officer offers the San Diego drunk driving / DUI police report, DMV records, San Diego DUI alcohol reports and the important San Diego DUI officer's sworn statement entitled a "DS 367." With no Fifth Amendment right at the hearing, your San Diego DUI / DMV attorney usually will not want you to be present at the hearing since the Driver Safety Officer can call you as a witness and force you to testify against yourself if you ill-advisedly appear.

San Diego DUI criminal defense attorneys challenge the competency and qualifications of officers when they can. One group of east county officers are now getting DUI training.

San Diego County sheriff's substation in Ramona is finally going to train all its deputies to be certified by the state to test drivers' breath and blood for alcohol and drugs.

6 Ramona deputies have been trained in last four months and certified by the state to test seemingly impaired drivers for alcohol and drugs, Lt. Duncan Fraser said. He said he hopes to have the remaining 11 certified by the end of the year so that the substation can better help California Highway Patrol with DUI patrols and checkpoints.

Relatively small substations in unincorporated areas such as Ramona often have a smattering of sheriff's deputies who are trained to screen drivers for alcohol and drugs, Fraser said, but they don't often have a universally certified staff of deputies.

Ramona substation deputies have always been able to use probable cause to stop impaired drivers and take them to the substation, Fraser said. But they often called the CHP to make final arrests because many deputies lacked state certification to confirm intoxication with chemical testing.

Deputies aren't required to get certification because department policy leaves most traffic arrests up to the CHP in unincorporated areas that don't contract the Sheriff's Department for special services, he explained.

CHP officers are certified by the time they graduate from the training academy, Fraser said.

"It’s always been the protocol that in unincorporated areas CHP picks up that part of enforcement," Fraser said of DUI arrests. "It doesn’t mean that we don't do DUI stops ---- we always have ---- but this will allow us to finish the arrests without relying on CHP."

Deputies can make DUI arrests without certification, Ramona deputies said, but that untrained deputies often defer to the CHP because an arrest is stronger in court if the arresting officer has met state training standards.

To get certified, deputies must complete 24 hours of training. They must learn how to tell drunken driving from bad driving, how to spot symptoms of intoxication, how to do field sobriety tests, and the protocol for conducting blood or breath tests.

Ramona's substation already has a breathalyzer because CHP officers use the station as a satellite office, Fraser said, so he didn't anticipate extra costs for equipment.

Deputies will receive training from the sheriff's station in Poway, San Diego DUI criminal defense lawyers learned today.

If so, as it currently stands, the answer to this question is "no"; however, that may change if additional California legislation is passed (or amended) that allows one to stay the DMV APS suspension action along with the second offense California DUI conviction (A-3 Suspension action).

Otherwise, you will not be eligible for a restricted driver's license until you have served the one year suspension action.

SDPD Officer James Zirpolo arrested 113 people for DUI. The next San Diego Police Department officer had 94 and the average among all officers who arrested at least one person was 14. Keep in mind that some officers, especially those in administrative roles, make few arrests so that brings the average down.

Almost all of Zirpolo's arrests were based on DUI / drunk driving charges in Pacific Beach or surrounding neighborhoods. He arrested 76 men and 37 women.

Officer Zirpolo says he worked four days a week and ten hours a day. During this time frame, Officer Zirpolo was working Tuesday through Friday; he had the weekends off.

If one accounts for the amount of time it takes to investigate and process a San Diego DUI arrest, including but not limited to the time it takes to administer all of the San Diego DUI field sobriety tests, breath testing, chemical testing, booking, impound, report-writing, and related San Diego DUI tasks, this appears to be an extraordinarily high number of drunk driving arrests in San Diego. Not too long ago, well-known San Diego DUI defense attorney exposed the questionable practices of a local blood drawer. (See San Diego DUI criminal defense lawyer Rick Mueller article here.)

Just as San Diego California DUI Criminal Defense Attorney Rick Mueller exposed outrageous memo telling San Diego California DUI prosecution blood draw witnesses how to testify, public defenders and other DUI lawyers in the northern trenches reveal new drunk driving evidence information.

There's a northern California twit that is now blogged for other DUI defense attorneys and DUI clients to view.

A blood drawer named Sedigh is known by many reputable DUI criminal defense attorneys and DUI lawyer prosecutors.

Ian Sedigh works for Arcadia Health Care as a phlebotomist. This company contracts with the San Francisco Police Department to take blood samples from DUI suspects. Deputy public defender Emily Dahm calls him a cagey "whack job" on the witness stand.

Read on because at the end of one recent trial, a juror showed Dahm a note he'd written during Sedigh's testimony: "Not only will I not let him draw my blood, I wouldn't let him draw the curtains in my living room." Prosecutors, meanwhile, say they can't even count on Sedigh to show up in court, and recently had to cut a plea deal with a DUI suspect in large part because of his role in the case.

Last month, deputy public defender Paul Myslin sent a letter of complaint about Sedigh to Arcadia and the California Department of Public Health. Myslin referenced a Nov. 10 police report that said Sedigh drew two vials of blood from a drunk-driving suspect's neck when he couldn't get enough blood from her hand. Sedigh's supervisor, Ariel Asilo, told SF Weekly that Sedigh denies the report, saying a General Hospital nurse did the neck draw. Yet Sedigh's own checklist mentions neither scenario, stating he took blood from the suspect's left arm.

Joseph Musallam, a state-accredited phlebotomy trainer at UCSF, says drawing from the neck could be very dangerous. "The neck? Holy Toledo! That guy must just be crazy, or a supercourageous guy," he said. "You might hit the major artery and bleed to death."

Even though the on-scene Breathalyzer results showed the suspect to be legally drunk, the DA allowed her to plead no contest to a reckless driving misdemeanor instead of a DUI charge earlier this month. "I believe the reason we were able to settle it was primarily because of the neck-draw issue" and Sedigh's failure to disclose it in his paperwork, Myslin says.

The medical examiner's forensic alcohol supervisor, Nikolas Lemos, has also had problems with Sedigh. According to lab records, Lemos routinely found Sedigh's casework to be sloppy, including time discrepancies, incomplete paperwork, and the use of test tubes from outside the approved DUI kit. Greg Barge, the district attorney's misdemeanor supervisor, says several of Arcadia's phlebotomists, including Sedigh, have failed to show up at hearings about whether to admit the blood alcohol content in trial, and so judges have often excluded the evidence. Prosecutors then have to let suspects plead to lesser charges although their blood alcohol levels showed they were drunk, he says. District attorney spokesman Brian Buckelew adds that "in some instances," they'll drop the case.

Barge says he has met with the police department, urging them to drop Arcadia. "My logical reaction is 'Screw them, they're out of a contract.' ... The department says it's hard to find another vendor who isn't even worse."

Prosecutors allege that a police officer and a federal agent fabricated a drug bust that led to the conviction of a Tulsa man and his daughter in 2008.

Prosecutors allege that Jeff Henderson, an undercover officer with TPD's Special Investigations Division, and Brandon McFadden, a current or former agent with the U.S. Bureau of Alcohol, Tobacco and Firearms, coached a drug informant and fabricated a drug buy on May 8, 2007, according to a federal document unsealed Tuesday in Tulsa County District Court.

The unsealed document is part of a federal probe into possible corruption of Tulsa law enforcement officers, records show.

The alleged fabricated drug bust by Henderson and McFadden led to the convictions of Larita Annette Barnes, 33, and Larry Wayne Barnes Sr., 59, on federal drug charges, records show.

The Barneses are represented by Tulsa attorney Art Fleak, who said he is prohibited from commenting.

Larry and Larita Barnes were released from federal prison last year because
the drug informant in the case, Ryan Logsdon, said he lied about the drug buy, the court filing unsealed Tuesday states.

The two were released July 2. Larry Barnes had served about one year on two 5 1/2-year sentences, which were to run concurrently. Larita Barnes had served about one year on two concurrent 10-year sentences.

Henderson, 37, did not return a call by the World. In a previous interview with the World, he has denied any wrongdoing.

Henderson, who has been with the Police Department about 14 years, was assigned to the Special Investigations Division in 2005.

The World could not locate McFadden for comment. The World submitted a federal Freedom of Information Act request on Nov. 2 to the ATF for the current job status of McFadden, 33.

The ATF said it could not confirm or deny McFadden's status with the agency.

The court filing that details Logsdon recanting his testimony was filed in the 10th U.S. Circuit Court of Appeals on June 25, 2009. However, the filing remained sealed until Tuesday.

The unsealed federal pleading is part of a motion in state court filed by Fleak on behalf of another client, Fred Allen Shields Jr. Fleak is seeking to have Shields' state drug case dismissed due to McFadden's involvement in the case, records show.

The federal motion was filed 10 months ago by U.S. Attorney Jane W. Duke, a special prosecutor in charge of a federal grand jury probe, the World investigation shows.

The Tulsa World first reported on the grand jury's investigation in November.

In the motion, Duke's office states: "The United States has now acquired evidence that the testimony offered at trial by Special Agent McFadden, Officer Henderson and Logsdon was false. It is the United States' belief that the alleged control buy that formed the basis of the indictment (against the Barneses), in fact, did not occur."

Duke's office corroborated Logsdon's story by subjecting him to a lie detector test which was administered June 22 in Fort Smith, Ark, records show.

Questions by federal investigators to Logsdon included:

"Did Henderson and McFadden coach your testimony prior to the Barnes' trial," court documents show.

"Yes," Logsdon answered.

In another question, Logsdon answers "no" when asked if he did a controlled drug buy on May 8, 2007.

On June 10, 2009, before the lie detector test was conducted, Logsdon told federal officials that Henderson provided him with three ounces of methamphetamine, the federal motion alleges. Logsdon said Henderson told him "you bought this from Larry and Larita Barnes," the motion states.

Henderson told Logsdon that the Barneses were major drug dealers whom law enforcement officers were having trouble bringing a case against, the motion alleges.

After Logsdon agreed to help fabricate the drug deal, Henderson and McFadden are accused of spending hours coaching him on his testimony against the Barneses, the motion states.

The motion states that $3,000 was used to facilitate the alleged drug purchase.

Additionally, Duke's filing states: "The information provided by Logsdon has also proven to be consistent with other information developed by law enforcement agents during the course of a public corruption investigation concerning certain Tulsa, Oklahoma, law enforcement officers."

The U.S. Attorney's Office for the Northern District in Tulsa has recused itself from at least one case in the investigation, records show.

The grand jury appears to be continuing its work.

Shields' federal conviction on drug charges was recently dismissed but he is being held on the state drug charge without bond.

Additionally, federal officials appear to be continuing to interview federal inmates expected to testify before the grand jury, the World investigation shows.

Inmates interviewed by the World in December said they were questioned about alleged missing money, nonexistent informants and tainted search warrants.

As first reported by the World on Nov. 1, the grand jury is meeting in a secret location to investigate alleged corruption of several officers assigned to the Tulsa Police Department's Special Investigations Division.

The World has reviewed the arrest and conviction records in two dozen state and federal criminal cases associated with 14 current and former prison inmates who sources say were called before the grand jury to testify in October and November.

The World reported Nov. 8 that a local defense attorney and his client reviewed a photo lineup that included several Tulsa police officers. Not all of the officers in the lineup are believed to be part of the federal probe.
